Switzerland is taking a significant step toward cannabis legalization. A legislative committee in the Swiss National Council has approved a draft plan that would allow adult access to marijuana under a strictly regulated system. While the proposal does not permit for-profit sales, it includes provisions for home cultivation, taxation, and state-controlled retail sales.
A Shift in Switzerland’s Cannabis Policy
Currently, the cultivation, production, trade, and consumption of cannabis for non-medical purposes are prohibited in Switzerland. However, lawmakers argue that prohibition has failed to protect public health and safety. The Social Security and Health Committee of the National Council, which approved the draft by a 14–9 vote, stated that a regulated cannabis market would better protect consumers, particularly minors, while curbing the illicit market.
According to a translated press release from the committee, “The majority of the Commission considers the current situation to be unsatisfactory and the prohibitive approach to be flawed. In their view, strictly regulated access to cannabis with a controlled market allows better protection of public health, strengthening youth protection and increasing safety.”
What the Proposed Law Allows
Under the new legislation, Swiss adults would be able to:
- Grow up to three flowering cannabis plants for personal use.
- Buy and possess cannabis within limits set by the government.
- Consume cannabis legally under state-controlled conditions.
The bill does not allow private companies to profit from cannabis sales. Instead, retail sales would be managed under a state monopoly, with profits directed toward addiction prevention, harm reduction, and public health initiatives.
Strict Regulations on Cannabis Sales and Packaging
To ensure safety and minimize risks, the proposal includes strict packaging and advertising regulations:
- Cannabis products must be sold in neutral packaging with clear warnings and child-proof features.
- Sales to minors will be strictly prohibited.
- Advertising of cannabis, seeds, and paraphernalia will be banned.
- Retailers must offer non-smokable and low-THC alternatives to encourage safer consumption methods.
Additionally, Switzerland will maintain its zero-tolerance drug driving laws, and illicit cannabis activities will be met with stricter penalties.
The Next Steps in the Legalization Process
Although the draft legislation marks a major milestone, it is only an early stage in Switzerland’s journey toward legalization. The next step involves the release of an explanatory report, which will allow the committee to further analyze the draft. Public stakeholders will also have the opportunity to provide input before the law advances to the full legislative process.
Switzerland’s Ongoing Cannabis Pilot Programs
Switzerland has already been experimenting with cannabis legalization through pilot programs. In 2023, the country launched a regulated sales trial, granting access to a limited number of participants. Zurich’s “Grashaus Project” allowed 2,100 residents to purchase cannabis from pharmacies and social clubs. Similar studies in Basel-Landschaft and Bern collected data on how legal cannabis impacts consumption habits and public health.
As the Swiss government evaluates the results of these programs, the newly proposed legislation represents an effort to transition from limited trials to a broader national framework.

If fully implemented, Switzerland’s approach could serve as a model for other European nations considering legalization. By focusing on harm reduction, public safety, and strict regulations, Swiss lawmakers aim to create a cannabis policy that balances individual freedoms with societal health concerns.
With this legislation moving forward, Switzerland joins a growing list of countries rethinking cannabis prohibition. While challenges remain, including regulatory logistics and public feedback, the approval of this draft marks a historic step toward a more progressive cannabis policy.
