										<content:encoded><![CDATA[<p>The Minnesota Office of Cannabis Management (OCM) has announced a significant shift in its cannabis licensing process. On Wednesday, the agency declared it would discontinue the controversial license lottery system for aspiring cannabis business owners.</p>
<p>This decision follows a judge’s ruling to halt the process due to a lawsuit filed by six individuals and business owners.</p>
<h3><strong>The Lawsuit That Changed the Game</strong></h3>
<p>The now-canceled lottery was originally slated for November 26, intending to preapprove cannabis licenses for verified businesses. However, the plaintiffs argued that the OCM excluded qualified business owners from participating fairly. The lawsuit alleged discriminatory practices that left deserving applicants sidelined.</p>
<p>In defense, the OCM claimed that the plaintiffs represented “a scheme to use hundreds of straw applicants to gain unfair advantage in the lottery.” Despite these allegations, the judge’s decision forced the agency to reassess its approach.</p>
<h3><strong>What Comes Next? A Shift to Standard Licensing</strong></h3>
<p>In place of the lottery, the OCM announced a <strong>standard licensing cycle</strong> set to begin in early 2025. This move is designed to provide a more transparent and equitable pathway for cannabis entrepreneurs. Under the new system:</p>

These companies allege that the state’s process for issuing cannabis transport licenses has consistently disadvantaged smaller, minority-owned businesses, giving larger, majority-owned companies a significant advantage.</p>
<h3>Background: The Fight for Fair Licensing in Cannabis Transport</h3>
<p>The plaintiffs, all Chicago-based, represent a range of minority- and women-owned transport firms, including ACC of Illinois Transportation, Runway Logistics Services, Hands to Heart, Reliavan, Fade Express, Piff Patch, and Moetta’s Transports. These small businesses, crucial in transporting cannabis products from cultivation centers to dispensaries, argue they have been systematically shut out of opportunities to thrive due to the state’s approach to licensing.</p>
<p>The lawsuit claims that the Illinois Department of Agriculture introduced an expedited, simplified licensing application for medical cultivation centers in July 2021—months before any independent transporters were licensed. These “quickie” applications favored large companies already operating in the state, the vast majority of which were white- and male-owned.</p>

<p>Minority- and women-owned businesses seeking to enter the market faced a much longer, more complex approval process, which meant they could only begin operations after their larger competitors had already secured contracts and built a customer base. By the time independent transporters finally received their licenses, the market was saturated, leaving little room for new entrants to succeed.</p>
<p>This extended waiting period led to severe financial strain for many minority-owned transport companies. With larger companies monopolizing the cannabis transport market, smaller businesses struggled to cover the debts accrued while awaiting their licenses. As a result, they had limited opportunities to compete fairly or even cover operational costs.</p>
<h3>Plaintiffs Highlight Economic Damage and Disparity</h3>
<p>Attorney Alissa Jubelirer, representing the plaintiffs, stated that the Illinois Department of Agriculture’s licensing practices have caused significant harm to minority-owned transporters, with 68% of these businesses now struggling or inactive. Jubelirer pointed out that this constitutes a “clear case of disparate impact discrimination” under the Illinois Civil Rights Act. The plaintiffs seek unspecified damages for future lost profits as well as compensation for the financial harm endured during the lengthy licensing delays.</p>

However, many social equity licensees have encountered obstacles, particularly in accessing funding, navigating compliance, and competing with well-capitalized incumbents.</p>
<p>In July 2024, the state released a disparity study underscoring these challenges. The report highlighted the struggles faced by independent transporters who lacked the resources of larger operators. The study revealed that minority and women entrepreneurs in the cannabis industry often face barriers such as complex regulations and limited access to capital.</p>
<h3>Industry Leaders Demand Structural Change</h3>
<p>Industry advocates, including Amber Lengacher, CEO of cannabis consulting firm Purple Circle, argue that Illinois regulators must do more to support social equity licensees. Lengacher, who has been lobbying for fair treatment of independent transporters since 2020, emphasized that Illinois’ cannabis program has fallen short of its diversity goals. She believes state regulators must take responsibility for ensuring a truly inclusive supply chain, especially as minority-owned businesses face higher hurdles to success.</p>
<p>“Lawmakers and regulators must understand that when they are propping up a brand new industry supply chain, they have a duty to ensure that the supply chain works for everyone, including social equity operators,” Lengacher stated.</p>

<p><a href="https://blackcannabismagazine.com/victoria-williams-got-her-cannabis-transport-license-shes-ready-to-change-the-game/">Victoria Williams of ACC of Illinois</a> shared a powerful perspective, recalling a childhood memory that reflects the long-standing injustices faced by Black communities:</p>
<p>&#8220;When I was a little girl, I remember the Chicago police kicking in our door to raid our home, with no regard for me as a child witnessing the trauma. A family member was taken out in handcuffs right in front of me, all because of cannabis. My story echoes that of so many Black people who were harmed by the War on Drugs, and yet, we’re the ones now facing the hardest hurdles to participate in the cannabis industry.</p>
<p>I wouldn’t have applied to be a transporter if Illinois’ HB1438 hadn’t promised contracts with the state’s 21 licensed cultivators. But that didn’t happen. Not only did the state delay our licenses—they fast-tracked those 21 cultivators instead, without subjecting them to the same rigorous process we went through. They were grandfathered in. There is no level playing field for us as Black entrepreneurs. This is discrimination. We are working three times as hard to participate in this industry, and it’s disheartening that those who could have upheld real social equity failed to protect it.&#8221;</p>
<p>Williams&#8217; story resonates deeply with the plaintiffs’ frustrations and highlights the broader challenges that social equity licensees continue to face.</p>

<h3>Shaping an Equitable Future</h3>
<p>Although Santa Monica has been slower than neighboring cities to embrace adult-use cannabis, the City Council’s October 2023 adoption of an Interim Zoning Ordinance marked a pivotal step. This ordinance allows the city’s two existing medicinal cannabis retailers—Harvest House of Cannabis and Local Cannabis Company—to sell recreational products. Now, city staff are developing a comprehensive ordinance to expand adult-use cannabis operations with an integral social equity component.</p>
<p>Cannabis social equity is more than just a buzzword. It’s an acknowledgment of the disproportionate harm experienced by minority communities due to past cannabis criminalization. According to the City’s April 2024 council meeting study session, this initiative aims to promote equitable ownership and employment opportunities in the cannabis industry and decrease disparities in outcomes for communities that have been most affected by the war on drugs.</p>
<h3>Community Engagement is Key</h3>
<p>For Santa Monica’s social equity program to be meaningful, officials are seeking input directly from residents. The city has launched a 10-minute survey available in both English and Spanish, which community members are encouraged to complete by November 30. The feedback gathered, coupled with data on local cannabis criminal arrests and demographic information, will guide the development of the social equity plan.</p>
<p>Beyond the survey, residents can attend a public cannabis equity workshop on November 13 at the Ken Edwards Center. <p>Sam Dabbs, owner of Harvest House of Cannabis, emphasized the importance of a well-structured program. He noted that many programs in Los Angeles failed to succeed due to insufficient financial backing and support, resulting in only a fraction of the intended stores opening. Steve Ratino, Compliance and Relations Officer at Harvest, agreed that a better-structured program is necessary to prevent failure.</p>
<p>Kyle Gordon, Operations Manager at Harvest, pointed out that collaboration could be key to Santa Monica’s success. He highlighted the need for the city to engage with existing business owners for input and advice to ensure the program’s success.</p>
<h3>A Long Time Coming</h3>
<p>The journey to legal cannabis sales in Santa Monica has been lengthy. The first dispensary in the city did not open until June 2023, a full six years after medical marijuana became legal in California. Now, with only two recreational cannabis retailers—Harvest House of Cannabis at 1418 Wilshire Blvd and Local Cannabis Company at 925 Wilshire Blvd—the city is looking to expand responsibly.</p>
<h3>Looking Ahead</h3>
<p>Santa Monica’s social equity program aims to ensure that those who have been most affected by past cannabis criminalization have fair opportunities to participate in and benefit from the legal industry. The social equity assessment, which will incorporate community feedback, is expected to shape key findings and recommendations that will be presented in early 2025.</p>

<h4><strong>A Personal Mission to Transform the Cannabis Industry</strong></h4>
<p>Harrington’s passion for cannabis began when he witnessed its positive impact on his grandmother’s glaucoma. Searching for natural relief for her, <a href="https://blackcannabismagazine.com/al-harrington-takes-viola-to-canada-cannabis-industry/">Harrington</a> discovered the medicinal power of cannabis and never looked back. This personal connection inspired him to team up with Dan Pettigrew, a fellow advocate and entrepreneur, to launch <em>Viola</em>, a cannabis brand dedicated to producing quality products while addressing the deep-rooted inequalities in the industry.</p>
<p>The journey from founding Viola to opening Village Brands has been one of vision and perseverance. While Viola focuses on producing top-tier cannabis products, Village Brands, their next venture, was created to expand their footprint through dispensary openings across the nation. The New Jersey location is the first on the East Coast, a milestone that holds significant meaning for Harrington.</p>

										<content:encoded><![CDATA[<p>NBA legend Gary Payton is making waves beyond the basketball court, and this time, he&#8217;s teaming up with Green Label Rx to launch a groundbreaking wellness brand: <strong><em>Greater Purpose</em></strong>. Set to debut at the highly anticipated Hall of Flowers event on September 20-21, this cannabis-infused wellness line promises to revolutionize recovery for athletes, professionals, and anyone leading an active lifestyle.</p>
<p>This project has been years in the making, evolving from Payton&#8217;s growing relationship with the cannabis industry. Interestingly, Gary Payton’s name became synonymous with cannabis long before his direct involvement, when the popular cannabis brand Cookies released a strain named after him—without his participation. According to Kenny Powerzzz, Gary Payton found out about the strain and was calling Berner (founder of Cookies) to get his share of the deal, but at the time, Berner didn’t even know who Payton was.</p>
